These Terms of Service ("Terms") govern your use of the Onedai website, assessment tools, tutoring services, and related features (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
Onedai is operated by Rudolfo Da Fonseca ABN 93 833 760 885, based in Perth, Western Australia.

1. Eligibility and Accounts
1.1 Who Can Use Onedai
The Platform is designed for:
- Parents and guardians of students in Years 3–10 (or equivalent) who wish to access assessment and tutoring services for their children
- Students who have been registered by a parent or guardian
- Educators who may be invited to join the Platform as tutors in the future
1.2 Parental Consent
A parent or guardian must register on behalf of any student under 18 years of age. By registering a student, you confirm that you are the parent or legal guardian of that student, or that you have authority from the parent or legal guardian to do so.
1.3 Accuracy of Information
You agree to provide accurate and current information when registering. If your information changes, please update it or contact us at [email protected].
2. Free Diagnostic Assessment
2.1 What's Included
The free diagnostic assessment includes:
- A 30-question, curriculum-aligned assessment covering literacy and numeracy
- An instant parent report showing strengths and areas for growth
- Curriculum alignment information (ACARA, IB, Cambridge, or US Common Core)
2.2 No Cost, No Obligation
The diagnostic assessment is free. No credit card is required. Completing the assessment does not obligate you to purchase any tutoring sessions or other services.
2.3 Assessment Limitations
The diagnostic assessment is designed to provide a general indication of a student's academic strengths and areas for growth. It is:
- Not a formal academic evaluation and should not be treated as a substitute for school-based assessments, NAPLAN results, or professional educational psychology assessments
- Indicative, not definitive — results may be influenced by factors such as test anxiety, fatigue, or the student's engagement on the day
- A starting point for conversation and targeted tutoring, not a complete picture of a student's abilities
3. Tutoring Sessions
3.1 Session Format
All tutoring sessions are conducted online via video conferencing (Zoom, Google Meet, or equivalent). Students require a device with a camera, microphone, and stable internet connection.
3.2 Session Duration
Standard sessions are 60 minutes unless otherwise agreed. Session times are scheduled through our booking system (currently Calendly).
3.3 Parent/Guardian Expectations
For students under 18, we recommend that a parent or guardian is present in the home during sessions, though they do not need to be in the same room. Parents are welcome to observe any session.
4. Pricing and Payment

All prices are in Australian Dollars (AUD) and include GST where applicable. For international clients, payments are processed in AUD and your bank may apply currency conversion fees.
4.2 Payment Terms
- Payment is due before or at the time of each session, unless a package has been purchased
- Package payments are due in full at the time of purchase
- Payments are processed through Stripe or by direct bank transfer, as agreed
4.3 GST
If Onedai is registered for GST, prices are inclusive of GST. Tax invoices will be provided on request.
5. Cancellation and Rescheduling
5.1 Cancellation by You

We understand that life happens, especially with families. In genuine emergencies, please contact us as soon as possible and we will work with you.
5.2 Cancellation by Onedai
If we need to cancel a session (e.g. due to tutor illness), we will provide as much notice as possible and offer a full reschedule at no cost. If we cancel with less than 24 hours' notice, you may request a credit toward a future session.
5.3 Package Refunds
If you have purchased a session package and wish to discontinue:
- Unused sessions may be refunded at the individual session rate (i.e. the package discount is removed from completed sessions, and the balance is refunded)
- Refund requests must be made in writing to [email protected]
6. Intellectual Property
6.1 Onedai's Content
All content on the Platform — including the website design, assessment questions, reports, blog articles, logos, and branding — is the intellectual property of Onedai and may not be reproduced, distributed, or used commercially without written permission.
6.2 Assessment Reports
Assessment reports generated for your child are provided for your personal use. You may share them with your child's school or other educators. You may not republish or distribute them commercially.
6.3 Session Materials
Materials provided during tutoring sessions (worksheets, resources, etc.) are for the student's personal educational use only.
7. Recording
Tutoring sessions may be recorded for the student's benefit (e.g. for review). Recording will only occur with the prior consent of both the parent/guardian and the tutor. Recordings are for the family's private use only and may not be shared publicly.
8. Code of Conduct
All users of the Platform agree to:
- Treat tutors, students, and other users with respect
- Use the Platform only for its intended educational purposes
- Not share account access with unauthorised individuals
- Not attempt to reverse-engineer, copy, or replicate the assessment tool or its questions
- Not submit false information during registration
We reserve the right to suspend or terminate access to the Platform for users who violate these terms.
9. Limitation of Liability
9.1 Educational Outcomes
Onedai provides professional tutoring services to the best of our ability. However, we cannot guarantee specific academic outcomes, test scores, or grade improvements. Educational progress depends on many factors including the student's engagement, practice between sessions, and school-based factors outside our control.
9.2 Technical Issues
Online sessions depend on technology and internet connectivity. We are not liable for disruptions caused by internet outages, software failures, or other technical issues beyond our control. If a session is significantly disrupted by technical issues on our end, we will offer a reschedule or credit.
9.3 Maximum Liability
To the maximum extent permitted by Australian Consumer Law, our total liability to you for any claim arising from these Terms or your use of the Platform is limited to the fees you have paid to Onedai in the 12 months preceding the claim.
9.4 Consumer Guarantees
Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Our services come with guarantees that cannot be excluded under Australian Consumer Law.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information and your child's data.
11. Dispute Resolution
If you have a concern about our services:
- Contact us first at [email protected]. We will work to resolve the issue within 14 days.
- If we cannot resolve the dispute, either party may refer it to mediation through a mutually agreed mediator.
- These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. The courts of Western Australia have non-exclusive jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates the most recent revision. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. For significant changes, we will notify registered users by email.
